As the administrative justice sector grows and evolves, the ‘traditional’ adjudicator role is changing.
An increasing number of boards, tribunals and agencies are requiring their adjudicators to step into the role of mediator. For even the most senior professional, this is a different skill set that must be learned and practiced.
Learn to shift your adjudicative mindset to efficiently resolve issues and cases before you.
Mediation for Adjudicators is designed to deal with the unique challenges faced by adjudicators who also mediate, before or during a hearing. You will gain confidence and improve effectiveness when dealing with conflict in a hearing, as well as in formal mediation.
What You’ll Learn
Learn how to analyze and diagnose the causes of conflict and options to manage and intervene in conflict effectively
Understand facilitative and evaluative approaches and techniques to support effective negotiation
Learn how to generate options, explore issues and develop a framework for mediation, including how to guide parties to identify common interests
Refine key communication skills, including active listening, framing and reframing
Explore the risks of mediation, “mediation-adjudication”, and consider best practices for transitioning between roles
Analyze the mediation theory: interest-based conflict resolution and other recommended approaches
Examine and practice key tools: opening remarks, mediation agreements and settlement agreements
Understand your professional responsibilities in this role, and how to navigate confidential and ethical dilemmas
Who Should Attend
Graduates of the SOAR/OsgoodePD Certificate in Adjudication
Those with two or more years of full-time experience as an adjudicator, OR an equivalent amount of experience as a part-time adjudicator
Senior tribunal staff, such as counsel, who work closely with adjudicators and would benefit from advanced training in adjudication
